
It turns out that Shia LaBeouf's
car accident where he struck another vehicle and flipped his Ford F-150 was not his fault.
Entertainment News International reports a L.A. County Sheriff's Department spokesman said the other driver was cited at the scene for running the red light at the intersection.
Mr. LaBeouf has not yet returned to work on "Transformers: Revenge of the Fallen" but his passenger and film co-star Isabel Lucas, who only received minor injuries, has returned to the set, the
Associated Press reports.

You're right, dunno where I got that from. However, I do know that on a first time non-injury offense where the BAC is right at .08, they can opt to only hit you with a Wet Reckless, which is almost as harsh but saves you the jail time. |

There's no such thing as "DWI" in California. However, if it's the first DUI offense, I believe they only charge the offender with a misdemeanor, unless you cause an injury accident, then I think it's a felony. DUI is a BAC above 0.08%. |

Oh, he was still drunk and arrested for a misdemeanor DUI. Just that the accident wasn't his fault. However, he is still in trouble since his drinking probably affected his ability to react quick enough to the person runnin the redlight.
