Hong Kong based retailer Action Robo has posted a notice on their shop page and Facebook that the legal division for Phillip Morris USA, Inc. has contacted them and warned against filling orders for this product bound for the United States. Previously our sponsor BigBadToyStore reported a similar communication, and it seems the reach is now extending to stores elsewhere in the world. Use of trademarked designs was again cited as cause for this action. Keep reading for more information.
Action Robo has subsequently canceled and is refunding orders from customers in the US. It's unclear at this point how far reaching Phillip Morris is in this, as so far only two stores have come forward acknowledging contact, but listings from other web stores in the US have also disappeared in recent weeks. Sale of Exhaust to the US may fall to a similar state of third party merchandise in the past at Botcon, with the equivalent of backroom deals and sales arranged through private channels as the risk to retail businesses is likely becoming too great.
Actionrobo was contacted by a law firm represent Philip Morris USA Inc. Informing us that the TAKARA/TOMY "MASTERPIECE MP-23 EXHAUST" figure infringes “Philip Morris USA Inc” trademark and such product cannot be sold in the USA.
To avoid further matter, listing on our website will be remove. All USA customers pre-ordered this figure will be refund.
